Development : America's Most Wanted

File this one under Concho, Arizona Development! America's Most Wanted will be covering this major arrest on Saturday night's show. Is there a doctor in the house?

Concho, AZ - Late Tuesday night Deputy United States Marshals teamed up with Sheriff Deputies from Apache County to capture a convicted sex offender, age 32, in Concho, Arizona.

This case originated from Laramie County Sheriff’s Office and the Wyoming Fugitive Task force led by the United States Marshals Service.

Arizona Department of Real Estate IGA Approved

The February 8, 2008 edition of the online White Mountain Independent newspaper is reporting that the Apache County Board of Supervisors approved an IGA with the Arizona Department of Real Estate for Subdivision Investigations.

Apache County - Declaration of a State of Emergency Resolution 2008 -01

A Declaration of a State of Emergency Resolution 2008 -01 has been posted on the Apache County website. A severe winter storm has hit the White Mountains and Apache County.

RESOLUTION 2008 -01

DECLARATION OF A STATE OF EMERGENCY

WHEREAS, it is the desire and duty of the Apache County Board of Supervisors to protect the health, safety and welfare of the citizens of Apache County;

WHEREAS, the current snow accumulations, many citizens of Apache County are stranded in their homes denying them access to food and medical assistance, endangering their lives and well being, threatening to damage their homes and property and endangering their livestock;

WHEREAS, when current and forecasted snow melts, many of the roadways in Apache County will become impassable due to the mud and water runoff and otherwise damaging the roadways that will strand many citizens of Apache County in their homes denying them access to food and medical assistance, endangering lives and wellbeing;

WHEREAS, Apache County acknowledges and thanks federal, state, BIA and tribal agencies now assisting with the emergency;

WHEREAS, the Apache County Board of Supervisors, pursuant to Arizona Revised Statutes Section 26-301 et seq. declares a State of Emergency to exist on private, state, federal and tribal lands;

BE IT FURTHER RESOLVED, that Apache County will provide mutual aid to the affected areas in Apache County pursuant to its ordinances, emergency plans and intergovernmental agreements which shall include personnel, equipment and other available resources;

BE IT FURTHER RESOLVED, pursuant to Arizona Revised Statutes Section 26-311, the chairman of the Apache County Board of Supervisors is authorized to issue any proclamation necessary and permissible concerning the current snow and mud emergency declared by the resolution;

Approved this 8th day of January, 2008.

Waiting on Governor Janet Napolitano For Help

Hundreds maybe thousands of Apache County land owners are owning land illegally subdivided in Apache County!

Thousands of hard working U.S. citizens across the U.S. may be holders of worthless Arizona land in Apache County. I have learned that thousands of acres of Apache County has been illegally subdivided.

At this time Apache County is waiting on the Governor of Arizona - Janet Napolitano for help in this crisis.

This meltdown could be a serious meltdown in the Apache County development.

Two-Bit Thief

The Arizona Republic has a nice quote from Special Prosecutor Grant Woods: "This sheriff, for all the good he did, ended up being a two-bit thief, day after day, month after month,"

Ousted Apache County Sheriff Brian Hounshell was sentenced to three years probation and one year deferred jail sentence in Maricopa County Superior Court on Friday. A deferred jail sentence means that the defendant has a grace period in which to demonstrate that he should not be incarcerated-in Hounshell's case six months.

Hounshell, 41, who was Apache County sheriff from 1999 until his recent resignation as part of a plea agreement, was originally charged with multiple counts, including conspiracy, fraudulent schemes and theft. In September, he was allowed to plead guilty to one count of solicitation for misuse of public monies. Source: Arizona Republic Newspaper

Subdivisions Within a Subdivision

I got this from the Arizona Department of Real Estate website. Apache County and Concho, Arizona land owners need to read this very important information. The land sales information below is also important if you own land in St. Johns, Hunt, Vernon, Snowflake, Sanders, Show Low, Greer, Pinetop, Lakeside, Heber, Joseph City, Holbrook, or Winslow.

Illegal subdivisions and mortgage fraud has been going on in the Arizona real estate market this past year.

Subdivisions Within a Subdivision

If a person purchases lots in an approved subdivision,
at what point does the purchaser become a
subdivider and need to obtain a public report before
offering any of the lots for sale?

A.R.S. § 32-2101(54) defines a subdivider as “any
person who offers for sale or lease six or more lots,
parcels or fractional interest in a subdivision or who
causes land to be subdivided into a subdivision for
the subdivider or others, or who undertakes to develop
a subdivision”.

A.R.S. § 32-2101(14) “Common Promotional Plan”
means a plan, undertaken by a person or group of
persons acting in concert, to offer lots for sale or
lease. If the land is offered for sale by a person or
group of persons acting in concert, and the land is
contiguous or is known, designated or advertised as
a common unit or by a common name, the land is
presumed, without regard to the number of lots covered
by each individual offering, as being offered for
sale or lease as part of a common promotional plan.”

A.R.S. § 32-2181(A) states in part “Before offering
subdivided lands for sale or lease, the subdivider
shall notify the commissioner in writing of the subdividers
intention”. (This means submitting an application
for public report.)

A.R.S. § 32-2183(F) states in part “ A subdivider
shall not sell or lease or offer for sale or lease in this
state any lots, parcels or fractional interest in a subdivision
without first obtaining a public report from
the commissioner except as provided in section 32-
2181.01 or 32-2181.02”.

Scenario 1

If a person owns or has an ownership interest in six
or more lots in an approved subdivision, that person
must obtain a public report. before offering for sale
or selling any of the lots

Scenario 2

If a person purchases three lots in a subdivision in
2004 and sells these lots, and then purchases 2 more
lots in this subdivision in 2005 and sells these lots, a
public report is not required. But if the person purchases
one or more lots in this subdivision after the
first 5 lots have been sold, the person is required to
obtain a public report for the subsequent lots. There
is no time limit over which the purchases occurred. If
the person purchases 3 lots in 1979 and sells them
and then in 2006 purchases three or more lots, the
person is required to obtain a public report before offering
any of the lots for sale.

Scenario 3

A subdivision was platted in 1926 and no improvements
have been made. In 2006 a person purchases
six or more lots. That person is required to obtain a
public report before offering any of the lots for sale.

Scenario 4

Mr. X purchases four lots in a subdivision. Mr. X
owns company Y, which purchases four lots in the
same subdivision. Mr. X and company Y are required
to obtain a public report prior to offering the lots for
sale.

For subdivision purposes ownership interest includes
but not limited to deeds, option agreements, executed
purchase contracts, trust agreements and agreements
of sale.
